Dispute Resolution

Alternative Dispute Resolution: Beyond the Courtroom

Litigation

Litigation can be costly and time-consuming. Alternative Dispute Resolution (ADR) methods such as mediation and arbitration offer faster, more cost-effective solutions. Learn about the benefits of ADR, when it's appropriate to use it, and how Lawxxx Advocates can guide you through the process to achieve favorable outcomes.

In today's fast-paced commercial world, businesses and individuals cannot afford to have disputes tied up in court for years. The Kenyan judiciary has actively promoted ADR as a means of reducing case backlogs and providing more efficient justice. Article 159 of the Constitution of Kenya encourages the use of ADR, making it a cornerstone of modern legal practice.

Understanding Mediation and Arbitration

While both are forms of ADR, mediation and arbitration have distinct differences:

  • Mediation: This is a voluntary and confidential process where a neutral third party (the mediator) helps disputing parties reach a mutually acceptable agreement. The mediator does not make decisions but facilitates communication and negotiation. The outcome is a settlement agreement that, once signed, becomes a legally binding contract.
  • Arbitration: This is a more formal process where the disputing parties present their cases to a neutral third party (the arbitrator or a panel of arbitrators). The arbitrator acts like a private judge and makes a legally binding decision known as an arbitral award. The award is enforceable in court, similar to a court judgment.
"ADR is not about avoiding justice; it's about finding a more efficient path to it. It empowers parties to control the outcome of their disputes."

When is ADR Appropriate?

ADR is suitable for a wide range of disputes, including:

  • Commercial and contract disputes
  • Employment and labor disagreements
  • Family matters, including divorce and child custody
  • Construction and real estate conflicts
  • Intellectual property disputes

However, ADR may not be suitable for cases involving criminal charges, constitutional matters, or where a legal precedent needs to be set.
